EFSCRJ Gravely Concerned by Supreme Court Judgment on the Unconstitutional Removal of the Auditor General

The Supreme Court rightly declared the removal of Auditor General Momodou Ceesay and his forcible eviction from office unconstitutional. However, by refusing to order his reinstatement and imposing no meaningful consequences on those responsible, the Court missed a critical opportunity to strengthen constitutional governance and deter future executive abuse.

Compensation alone cannot remedy a constitutional violation. The Constitution must be defended through effective remedies that restore constitutional order, protect the independence of public institutions, and ensure that those who violate the supreme law are held personally accountable, not taxpayers.

This is now the second time the Supreme Court has found President Adama Barrow to have acted unconstitutionally. EFSCRJ therefore calls on the National Assembly to exercise its oversight powers, demands accountability from all public officials involved, and urges every Gambian to stand up in defense of the Constitution. No one is above the law, and constitutional violations must never become the norm.
